SOME EXAMPLES OF CONDITIONS OF NATURE ARE: Thunder, lightening, rain, wind, other wild and domestic animals, flying, biting or stinging insects, reptiles, scorpions, snakes, irregular footing the buildings and out-of-doors, groomed or wild land which is subject to unpredictable changes in condition according to weather and temperature as well as natural and man-made changes in the landscape.
By electing to participate in any outdoor activity such as horseback riding, branding of cattle/horse, or many of the other Ranch activities described in the Cowboy Way of Life on The Thomas Ranch.com and all guests accept the premises and facilities, manmade or natural, in their AS-IS state and condition, and agree to take any and all necessary and reasonable precautions for their own safety and well-being during their stay.
The Thomas Ranch suggests that all “Guests” sign a waiver stating that they understand the warnings and assumptions of risk and that they release in full The Thomas Ranch from all claims and/or liability for injuries and/or accidents which could result in medical treatment, hospitalization, disability or death. Guests must agree to give permission for staff or other agents of The Thomas Ranch to provide reasonable First Aid/Emergency Assistance and/or to summon Medical Assistance in the event of accident or injury to any member of their group, if occupying said Ranch.
Disputes:
The present General Conditions are subject to American Arbitration. Any dispute will be handled per Arbitration per the State of Oklahoma, or the State of Arizona, whichever is easier for the members of The Thomas Ranch. Arbitration will be considered using adjudication, negotiation, cooperation, compromise, concession, conciliation, enabling two parties involved the ability of finding the middle ground, give and take, mediation, settlement, intercession to end the confrontation, argument, disagreement, quarrel, and altercation, war of words, ending a conflict, disagreement, clash, divergence, difference, argument, variance, quarrel, and any inconsistency.
